1) GENERAL NOTES

These general terms and conditions of sale (GENERAL CONDITIONS) are governed by the Consumer Code (Legislative Decree no. 70/2003 as amended and supplemented) and apply exclusively to distance selling via the web of the products shown on the site www.oliosanfilippo.com The validation of an order implies the tacit reading and acceptance of the General Terms and Conditions present at that time.

In accordance with current Italian and EU laws, the economic relationship between the seller and the customer is governed by consumer protection legislation

only if the customer buys for personal purposes unrelated to his business activity. Therefore, the relations between the seller and the professional who buys for purposes related to his business activity, whether of an entrepreneurial or commercial nature, providing his VAT number, are not subject to consumer protection regulations including, in particular, Legislative Decree no. 185 of 1999 (contracts concluded at a distance), Legislative Decree no. 50 of 1992 (right of withdrawal) and articles 1469 bis et seq. of the Civil Code.

2) PRICES AND PAYMENTS

All products and their prices shown on the site include VAT. Delivery charges and charges for additional labour services provided by Sanfilippo Oil are to be borne by the customer for amounts less than 50€.

Service costs (bottling of extra virgin and olive oils of various kinds not produced in-house) are to be agreed upon with the customer.

3) HOW TO EXECUTE ORDERS

A) Purchase Orders shall be placed online through the order procedure (hereinafter the "Order Procedure") available on the Site in the shop section. The Customer shall add the Product to the "Shopping Cart" and, after having read the General Terms and Conditions and the Privacy Policy, shall enter the shipping and billing information, select the desired payment method and confirm the order.

By confirming the order, which has the value of a contractual proposal, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure and that he/she fully accepts the transcribed General Terms and Conditions and Payment Conditions.

B) The contract stipulated with the Customer shall be deemed concluded with the acceptance, by the Sanfilippo Oil Mill Company, of the order. Such acceptance is communicated to the Customer by means of an email confirming the order. If the Customer is a consumer (i.e. a natural person who purchases goods for purposes not related to his professional activity), once the online purchase procedure is concluded, he shall print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of Italian law on distance contracts.

Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or property, caused by the non-acceptance or non-fulfilment, even partial, of an order is excluded.

4) DELIVERY AREA

The Azienda Olearia Sanfilippo delivers all over the country and Europe by contracted express couriers.

For Europe, shipping is by air or truck, so it is possible to place minimum orders of up to 50 kg including pallet and packaging.

Deliveries are made directly to the address indicated by the customer when placing the order;

Ordered goods therefore travel entirely at the risk of Azienda Olearia Sanfilippo.

Depending on the destination area of the goods (Italy/Europe), deliveries may be made within 2 to 15 days, barring mishaps. All purchases will be delivered by express courier from Monday to Friday, excluding public holidays and national holidays.

After the goods have been dispatched, a confirmation email with a tracking number will be sent to the customer, which will include a link to refer to for tracking the shipment.

5) CANCELLATION OF PURCHASE ORDERS

If the Customer wishes to cancel his Order, he may do so within 24 (twenty-four) hours after payment, at no additional cost.

In that case, Frantoio Sanfilippo shall refund the Customer the full amount.

6) PRODUCT UNAVAILABILITY

Should the products ordered be temporarily unavailable, Azienda Olearia Sanfilippo shall promptly inform the Customer, without prejudice to the latter's right to cancel the order.

7) RIGHT OF WITHDRAWAL

Pursuant to the combined provisions of Articles 64 et seq. of the CONSUMER CODE (Legislative Decree No. 2005/206) and the provisions of Legislative Decree No. 21 of 21 February 2014, the end-consumer customer has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without penalty.

In order to exercise this right, the customer shall send a communication within 14 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgement of receipt, addressed to: Azienda Olearia di Sanfilippo Daniele C/DA San Pietro SNC Castronovo di Sicilia (PA) 90030 Once we have received the aforesaid communication of withdrawal, the customer service will communicate to the customer the instructions on how to return the goods, which must be received at our warehouses within 10 days from the authorisation.

The right of withdrawal is however subject to the following conditions:

1. The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product

2. In accordance with the law, shipping costs for the return of the goods shall be borne by the customer

3. Shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer

4. we shall not be liable in any way for damage to or theft/loss of goods returned by uninsured shipments

5. In the event of damage to the goods during transport, the customer shall be notified (within 5 working days of receipt of the goods in our warehouses), to enable him/her to file a complaint against the carrier of his/her choice and obtain reimbursement of the value of the goods (if insured). In this case, the product will be made available to the customer for its return at the same time as cancelling the request for withdrawal

6. The right of withdrawal cannot in any way be exercised in respect of perishable goods whose expiry date is less than or equal to 10 days.

We shall refund the customer the full amount already paid, within 30 days from the return of the goods, by means of a transfer of the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to provide the bank details on which to obtain the refund.

The right of withdrawal lapses completely, due to the lack of the essential integrity of the goods (packaging and/or its contents), in cases where it is ascertained that: a. The lack of the external packaging and/or label of the product purchased, b. Damage to the product due to causes other than its transport.

In the event of forfeiture of the right of withdrawal, the purchased goods shall be returned to the sender, who shall be charged with the shipping costs. The right of withdrawal is in no way exercisable by professionals.
